Know Your Rights: How to Appeal a Return Decision Issued by the General Inspectorate for Immigration

Did you know that if the General Inspectorate for Immigration has issued you a return decision, you have the right to appeal it?

➡️ The competent Court which is competent to analyze your complaint against a returning decision is a Court of Appeal and often is that one in which territorial area is the Immigration Department which issued return decision. E.g. If the Bucharest Immigration Department issued the return decision, then the Bucharest Court of Appeal is the competent court.

➡️ It is very important to know you have only 10 days to appeal the returning decision from the time that decision was handed over to you or you received it by post. Sometimes, when the Immigration authority does not know the address, that return decision will be posted at the premises of Immigration Department.

➡️ It is also important to know that not any time the return decisions issued by immigration authorities comply with all relevant legal provisions and then the courts can cancel these return decisions.
